  • Provide strategic advice to clients on copyright, trademark and domain name matters.

  • Draft trademark applications, responses to office actions, recommendations and advice on trademark and copyright registration and enforcement opportunities.

  • Audit portfolios against marks in use, identify gaps in registration portfolio and provide strategic recommendations to build a filing portfolio that best serves clients.

  • Mentor new attorneys.

Enterprise Holdings, Inc., Clayton, Missouri

Intellectual Property Counsel

 January 2002 to April 2020

  • Spearheaded the intellectual property (“IP”) registration, watch and enforcement programs for the largest car rental company in the world.

  • Registered trademark and domain names to support expansion efforts in over 100 countries.

  • Oversaw work on complex contested intellectual property matters.  The largest project included 135 separate contested matters (trademark litigation, cancellation actions, oppositions or defense against non-use cancellation actions) in 43 jurisdictions worldwide against one trademark owner.  Enterprise received a favorable decision in London, which led to settlement of all other matters.  

  • Managed trademark spend and draft project proposals, strategies and budget forecasts.  

  • Provided legal review and filing strategies for proposed new trademarks.

  • Drafted business agreements, trademark licenses, settlement agreements and software terms of use.

  • Managed intercompany trademark licensing program.

  • Managed work of internal paralegal and administrative assistant and outside counsel in countries world-wide.

  • Oversaw the worldwide intellectual property portfolio for the Enterprise family of companies, including trademarks (approximately 11,000 trademark filings), patents (over 70 filings) and domain names (over 8,000 names).  

  • Led negotiations, trademark mediations, discovery and internal strategy sessions for various intellectual property projects.

  • Led the intellectual property due diligence, transition and acquisition of IP portfolios of all sizes from small companies with only common law rights to large companies with world-wide portfolios of up to 2,000 trademark filings and 3,000 domain names.

  • Advised all levels of management on intellectual property and electronic commerce issues.

  • Served on various company committees including Trademark Committee - leader/moderator (2019-2020), Patent Committee - leader/moderator (2002-2013), Privacy Committee (2008-2010), Diversity/Work Life Balance Committee (2008-2010).

  • Audited, updated and drafted uniform online protection product descriptions for over thirty (30) markets in Latin America to ensure accuracy and legal compliance.

  • Managed the legal work, from conception to issuance, for the company’s first 12 business method patents including management of patent search, strategic planning and prosecution (January, 2000 - July, 2013).

  • Attended meetings with Patent Examiners at the US Patent and Trademark Office (2002-2013)

  • Lead legislative branch of county government.

  • Lead various legislative committees, including committee to draft and pass Prop P in 2018.

  • Coordinate efforts of government and charitable entities to serve over 1,000 flood victims following the December 2015 and May 2016 floods.

  • Serve on various intergovernmental committees.

  • Draft, consider and pass ordinances, resolutions and amendments.

  • Served as the first Chair of the County Council during the first year Jefferson County operated as a First Class, Charter form of government.

  • Review and select vendors for Jefferson County road and bridge projects.

  • Review and pass annual balanced budgets for county government.

  • Organize, address and serve as master of ceremonies for town hall meetings, congressional district visits, seminars for subdivision residents and various public events.

  • Elected in 2010 and re-elected in 2012 and 2016; running unopposed in 2020 to represent 25,000 Jefferson County, Missouri residents.

  • Elected by a majority of Councilmembers to serve in leadership positions for seven one-year terms

Letters to the Editor: in addition to the published articles above, I have written several letters published in the local newspaper, The Leader, on topics relating to resources available to citizens and local government matters.

Legislation: I was the main drafter of the Rules of Procedure now used by the Jefferson County Council.  I have also drafted several pieces of legislation for County ordinances, bills and resolutions and State laws and regulations.  I have also drafted amendments for all these types of legislation.
